I. Acceptance of Terms
Webydo provides you with access to its website and Services allowing you to create, design, and manage professional HTML websites without writing code.
As a precondition and requirement to use the Services available via Webydo.com, you, for yourself and for the company or other person(s) you represent ("Subscriber"), hereby accept and agree to be legally bound by these Terms of Service ("Terms").
Subscriber represents and warrants that, if an individual, Subscriber is at least 18 years old and otherwise legally competent. If an entity, Subscriber is a legal entity duly formed and in good standing.
II. Proprietary Rights
These Terms do not give Subscriber any rights in Webydo intellectual property or technology. Webydo and related trademarks and logos are the exclusive property of Webydo.
User License
Subject to the terms and conditions of this Agreement, Webydo hereby grants Subscriber a non-exclusive license to access and use the Services solely for the purpose of creating and managing websites. Subscriber is allowed to grant End Users the right to access the websites created using the Services.
Third-Party Content Restrictions
Any duplication, distribution, modification, sublicensing, or reverse engineering of Third Party Content (images, fonts, etc.) provided by Webydo is strictly prohibited unless specifically allowed.
III. Refund Policy
Upon the purchase of any subscription plan, whether on a monthly or annual basis, the Subscriber acknowledges and agrees that all fees paid are non-refundable.
This policy applies regardless of the time remaining in the subscription period. Once a payment has been processed, the Subscriber will not be entitled to a refund, credit, or proration of any kind.
Anti-Fraud & Commission Reversals
Webydo upholds a strict anti-fraud policy. Any partner found engaging in fraudulent activities to earn commissions will face immediate account termination and forfeiture of all earned commissions.
IV. Security & Liability
Webydo uses sophisticated security means, yet it is exclusively Subscriber's obligation to maintain and control passwords to Subscriber's web site(s).
Limitation of Liability
Webydo expressly disclaims all liability for any direct, indirect, incidental, consequential, special, or punitive damages arising out of or related to the use of the Services. This includes, but is not limited to, loss of content, service interruptions, or security breaches.
Webydo shall not be liable for any errors, omissions, or unintended modifications made to a Subscriber’s website resulting from the Subscriber’s own use of the platform (including AI tools) or by any individual granted access by the Subscriber.
V. AI & Generative Technologies
Generative AI Disclaimer
Webydo provides access to Artificial Intelligence (AI) tools ("WebydoAssist", "AI Vibe Builder") to assist in content creation. By using these features, you acknowledge and agree to the following:
- Accuracy ("Hallucinations"): AI may generate incorrect, misleading, or offensive information. You are solely responsible for reviewing and verifying all AI-generated content before publishing. Webydo accepts no liability for errors produced by AI.
- Ownership & Copyright: While Webydo assigns rights to the output to you, we cannot guarantee that AI-generated works are copyrightable under your local laws. The legal status of AI art and text is evolving.
- No Reverse Engineering: You may not use Webydo's AI outputs to train, fine-tune, or improve other AI models or competing services.
- Indemnification: You agree to indemnify Webydo against any claims arising from your use of AI-generated content that infringes upon the rights of third parties.
VI. Renewal & Termination
Automatic Renewal: Webydo will automatically renew the applicable Service(s) for a period equal to the original subscription duration. Fees will be charged automatically unless a termination notice is provided.
Termination
Subscriber may request to terminate their account at any time by providing notice to billing@webydo.com. To avoid automatic renewal charges, termination requests must be made at least 30 days prior to the expiration of the current period.
Webydo Inc. reserves the right to alter these Terms at any time.
